The service is hosted and processed in the United States using infrastructure operated, managed, or coordinated by 314.media \/ 314media, including 314.media co-located or managed hosting environments and related service providers.<\/p>\n<p>By creating an account, connecting a website, installing the LevelUp Connector WordPress plugin, authorizing a Google integration, starting a free trial, purchasing a subscription, using a scan, or otherwise accessing LevelUp Stats, you agree to these Terms. If you do not agree, do not use LevelUp Stats.<\/p>\n<p><strong>Plain-English summary:<\/strong> LevelUp Stats helps you understand website performance and SEO opportunities. It does not guarantee rankings, revenue, traffic, AI visibility, search engine placement, or business outcomes. You are responsible for websites and accounts you connect, changes you approve, and how you use recommendations.<\/p>\n<hr>\n<h2>1. Definitions<\/h2>\n<p>For purposes of these Terms:<\/p>\n<ul>\n<li><strong>\u201cLevelUp Stats,\u201d \u201cwe,\u201d \u201cus,\u201d or \u201cour\u201d<\/strong> means the LevelUp Stats service operated by 314media.<\/li>\n<li><strong>\u201cService\u201d<\/strong> means the LevelUp Stats website, dashboard, app, scans, reports, missions, recommendations, WordPress connector, Google integrations, AI-assisted features, billing flows, support, and related services.<\/li>\n<li><strong>\u201cUser,\u201d \u201cyou,\u201d or \u201cyour\u201d<\/strong> means the person, business, agency, organization, or authorized representative using the Service.<\/li>\n<li><strong>\u201cCustomer Data\u201d<\/strong> means information, content, website data, analytics data, SEO data, Google data, WordPress data, keywords, reports, files, or other materials you submit, connect, upload, authorize, or generate through the Service.<\/li>\n<li><strong>\u201cWebsite\u201d<\/strong> means any domain, WordPress site, page, account, property, or digital asset that you connect to or manage through LevelUp Stats.<\/li>\n<li><strong>\u201cMissions\u201d<\/strong> means recommended SEO, content, technical, visibility, backlink, local SEO, or website improvement tasks generated or tracked by LevelUp Stats.<\/li>\n<li><strong>\u201cPlugin\u201d<\/strong> means the LevelUp Connector WordPress plugin and related WordPress integration features.<\/li>\n<\/ul>\n<h2>2. Eligibility and Authority<\/h2>\n<p>You must be at least 18 years old, or the age of majority in your jurisdiction, to use LevelUp Stats. LevelUp Stats is intended for business, professional, agency, website owner, and authorized representative use.<\/p>\n<p>If you use LevelUp Stats on behalf of a company, client, employer, agency, or other organization, you represent and warrant that you have authority to bind that organization to these Terms and to connect, manage, scan, or submit data for the websites and accounts you add.<\/p>\n<p>You may not connect, scan, modify, monitor, or submit data from any website, Google account, analytics property, WordPress site, business profile, or digital property unless you have the legal right and authorization to do so.<\/p>\n<h2>3. Account Registration and Security<\/h2>\n<p>You may need an account to use certain features. You agree to provide accurate, current, and complete information and to keep it updated.<\/p>\n<p>You are responsible for maintaining the confidentiality of your login credentials, all activity under your account, appropriate permissions for team members, promptly notifying us of unauthorized access or suspected compromise, and using reasonable security practices.<\/p>\n<p>We may suspend or terminate access if we believe an account is compromised, fraudulent, abusive, unauthorized, or creates risk to LevelUp Stats, other users, websites, third-party services, or the public.<\/p>\n<h2>4. Description of the Service<\/h2>\n<p>LevelUp Stats provides tools that may include website scans and SEO audits, search visibility observations, AI visibility analysis, Google reporting integrations, backlink monitoring, mission generation, progress tracking, gamification, WordPress plugin workflows, reports, dashboards, exports, notifications, and support.<\/p>\n<p>Features may vary by plan, account type, integration status, provider availability, beta status, and technical limitations.<\/p>\n<h2>5. No SEO, Ranking, Traffic, Revenue, or AI Visibility Guarantees<\/h2>\n<p>LevelUp Stats provides analysis, recommendations, tracking, and workflow tools. We do not guarantee first-page rankings, keyword positions, Google rankings, map pack placement, AI Overview placement, AI citation placement, local rankings, backlinks, traffic, leads, conversions, sales, revenue, profit, or that any third-party platform will crawl, index, display, rank, cite, or recommend your website.<\/p>\n<p>Search engines, AI systems, social platforms, directories, analytics tools, and third-party providers can change their algorithms, policies, data access, reporting, and availability at any time. You are responsible for evaluating recommendations before taking action.<\/p>\n<h2>6. AI-Assisted Recommendations<\/h2>\n<p>LevelUp Stats may use AI-assisted features to generate missions, summaries, analysis, explanations, content suggestions, keyword ideas, technical observations, and other recommendations.<\/p>\n<p>AI outputs may be incomplete, outdated, inaccurate, offensive, duplicated, misleading, or unsuitable for your business, website, industry, legal obligations, or brand. You are responsible for reviewing, editing, validating, and approving AI-assisted outputs before using them.<\/p>\n<p>AI-generated or AI-assisted content should not be treated as legal, financial, medical, tax, professional, or compliance advice. You are responsible for ensuring any content you publish is accurate, lawful, non-infringing, and appropriate.<\/p>\n<h2>7. Google Integrations<\/h2>\n<p>If you connect Google services, including Google Search Console, Google Analytics, or Google Business Profile, you authorize LevelUp Stats to access and process the Google data you approve through Google OAuth for the purposes described in these Terms and our Privacy Policy.<\/p>\n<p>You represent that you have the authority to connect each Google account, property, website, analytics property, business profile, or location.<\/p>\n<p>Your use of Google services remains subject to Google\u2019s applicable terms, policies, and permissions. Google may change, suspend, limit, or terminate APIs, scopes, quotas, permissions, review status, or access at any time. LevelUp Stats is not responsible for Google outages, access restrictions, reporting delays, API errors, OAuth issues, quota limits, or data differences.<\/p>\n<p>LevelUp Stats\u2019 use and transfer of information received from Google APIs will adhere to the <a href=\"https:\/\/developers.google.com\/terms\/api-services-user-data-policy\" target=\"_blank\" rel=\"noopener\">Google API Services User Data Policy<\/a>, including the Limited Use requirements, as described in our Privacy Policy.<\/p>\n<p>You may disconnect Google services through available LevelUp Stats settings, through your Google Account permissions, or by contacting support.<\/p>\n<h2>8. WordPress Connector Plugin<\/h2>\n<p>If you install or connect the LevelUp Connector WordPress plugin, you authorize the Plugin and LevelUp Stats to communicate with your WordPress website for supported features.<\/p>\n<p>The Plugin may support reading SEO-related page data, checking titles and meta descriptions, queuing approved missions, applying approved SEO changes where supported, verifying mission completion, storing connection status, maintaining diagnostics, and supporting rollback or restore workflows where available.<\/p>\n<p>You are responsible for backing up your WordPress site before applying changes. You are responsible for reviewing plugin actions before approval. LevelUp Stats is not responsible for website breakage, theme conflicts, plugin conflicts, caching issues, SEO plugin conflicts, hosting restrictions, WordPress updates, failed writes, lost edits, ranking changes, or business impacts caused by approved changes, third-party systems, or site-specific conditions.<\/p>\n<p>LevelUp Stats does not intentionally publish new WordPress pages or modify your website unless you approve the action, enable the relevant automation, or otherwise authorize the change.<\/p>\n<h2>9. Customer Data and Ownership<\/h2>\n<p>As between you and LevelUp Stats, you retain ownership of Customer Data you submit, connect, upload, or authorize.<\/p>\n<p>You grant LevelUp Stats a non-exclusive, worldwide, royalty-free license to host, copy, process, transmit, display, analyze, transform, and use Customer Data as needed to provide, secure, support, and improve the Service; generate scans, missions, reports, summaries, and recommendations; connect integrations and display data; verify completion of missions; troubleshoot problems; comply with law; and enforce these Terms.<\/p>\n<p>You represent and warrant that you have all rights, permissions, and authority needed to provide Customer Data to LevelUp Stats and allow us to process it as described in these Terms and our Privacy Policy.<\/p>\n<h2>10. User Responsibilities<\/h2>\n<p>You are responsible for the accuracy and legality of information you submit, obtaining required permissions, reviewing recommendations before implementation, maintaining backups of websites and content, complying with laws and third-party terms, and responding to notices, complaints, takedown requests, user requests, and legal obligations involving your websites or content.<\/p>\n<h2>11. Acceptable Use<\/h2>\n<p>You agree not to use LevelUp Stats to violate law or third-party rights, connect or modify websites without permission, misrepresent identity or results, upload malware, gain unauthorized access, reverse engineer or scrape the Service, bypass usage or security limits, send spam or deceptive marketing, generate unlawful content, manipulate reviews or rankings, engage in black-hat SEO or link schemes, copy the product for a competing service, or disrupt LevelUp Stats or third-party systems.<\/p>\n<p>We may investigate violations and suspend, limit, or terminate access where appropriate.<\/p>\n<h2>12. Reviews, Testimonials, Endorsements, and Public Claims<\/h2>\n<p>If you provide a testimonial, review, case study, quote, social post, or endorsement about LevelUp Stats, you agree that it must reflect your honest opinions, findings, beliefs, or experience and must not be misleading.<\/p>\n<p>If you have a material connection to LevelUp Stats, such as compensation, free service, affiliate relationship, ownership, employment, or another benefit, that connection must be clearly disclosed where required by law.<\/p>\n<p>You may not make false, deceptive, or unsubstantiated claims about results achieved using LevelUp Stats.<\/p>\n<h2>13. Plans, Trials, Subscriptions, Billing, and Auto-Renewal<\/h2>\n<p>Some features require a paid subscription. Pricing, plan limits, trial terms, renewal terms, and included features are shown at checkout, in the app, on an order page, or in a separate agreement.<\/p>\n<p>By starting a paid plan, free trial that converts to a paid plan, or subscription, you authorize us and our payment processor to charge the payment method you provide for applicable fees, taxes, and recurring charges according to the plan terms presented to you.<\/p>\n<p>Subscriptions may automatically renew unless canceled before the renewal date. You are responsible for canceling before renewal if you do not want to continue. Cancellation methods may be available in the billing area, account settings, or through support.<\/p>\n<p>We aim to make material subscription terms clear before signup, including price, billing frequency, trial length, renewal timing, and cancellation instructions.<\/p>\n<h2>14. Cancellations and Refunds<\/h2>\n<p>You may cancel your subscription according to the cancellation options available in your account or by contacting support at <a href=\"mailto:support@levelupstats.com\">support@levelupstats.com<\/a>.<\/p>\n<p>Unless required by law, stated at checkout, or separately agreed in writing, fees are non-refundable and cancellation stops future renewal charges rather than refunding past charges. If you cancel during a billing period, you may retain access until the end of the paid term unless the account is terminated for violation of these Terms.<\/p>\n<p>We may refuse refunds for abuse, fraud, policy violations, excessive usage, chargeback manipulation, or accounts terminated for cause.<\/p>\n<h2>15. Taxes<\/h2>\n<p>Prices may not include taxes unless stated. You are responsible for applicable taxes, duties, levies, and governmental charges, except taxes based on our income. We or our payment processor may calculate, collect, and remit taxes where required.<\/p>\n<h2>16. Payment Processing<\/h2>\n<p>Payments may be processed by Stripe or another third-party payment processor. Payment processing is subject to the payment processor\u2019s terms, policies, and privacy practices.<\/p>\n<p>LevelUp Stats does not intentionally store full credit card numbers. We may store payment processor identifiers such as customer IDs, subscription IDs, invoice IDs, billing status, plan status, cancellation status, and transaction references.<\/p>\n<h2>17. Changes to Pricing, Plans, and Features<\/h2>\n<p>We may change pricing, plan names, plan limits, features, trial terms, included usage, quotas, or availability from time to time. We will provide notice where required by law or where the change materially affects existing paid subscriptions.<\/p>\n<h2>18. Beta, Experimental, and Preview Features<\/h2>\n<p>Some features may be labeled beta, preview, experimental, early access, test, or similar. These features may be unstable, incomplete, inaccurate, changed without notice, or discontinued. Beta features are provided as-is and may be subject to additional limits.<\/p>\n<h2>19. Third-Party Services<\/h2>\n<p>LevelUp Stats may integrate with or rely on third-party services, including Google, Stripe, WordPress, hosting providers, email providers, AI providers, analytics tools, search data providers, and other vendors.<\/p>\n<p>We are not responsible for third-party services, including outages, policy changes, API limits, pricing changes, data errors, unavailable data, security incidents, billing issues, or decisions made by those providers. Your use of third-party services is governed by their own terms and policies.<\/p>\n<h2>20. Service Availability, Maintenance, and Changes<\/h2>\n<p>We work to keep LevelUp Stats available and reliable, but we do not guarantee uninterrupted, error-free, or secure access. The Service may be unavailable due to maintenance, updates, hosting issues, third-party outages, API limits, security events, bugs, network issues, or circumstances beyond our control.<\/p>\n<p>We may modify, suspend, or discontinue any part of the Service at any time, subject to applicable law and any written commitments in an active paid agreement.<\/p>\n<h2>21. Intellectual Property<\/h2>\n<p>LevelUp Stats and its software, designs, text, graphics, workflows, interfaces, logos, icons, branding, reports, templates, algorithms, mission logic, scoring systems, documentation, and other materials are owned by 314media, LevelUp Stats, or their licensors and are protected by intellectual property laws.<\/p>\n<p>These Terms do not grant you ownership of LevelUp Stats or its intellectual property. You may use the Service only as allowed by these Terms.<\/p>\n<p>You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works from LevelUp Stats except as expressly permitted by law or written agreement.<\/p>\n<h2>22. Feedback<\/h2>\n<p>If you provide ideas, requests, suggestions, bug reports, feature concepts, designs, or other feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use, modify, commercialize, and incorporate that feedback without compensation or obligation to you.<\/p>\n<h2>23. Publicity<\/h2>\n<p>We will not intentionally publish your private customer data. We may identify you as a customer or use your name, business name, logo, testimonial, or case study only where you authorize it, where it is already public and used lawfully, or where allowed by a separate agreement. You may contact us if you want a public reference removed.<\/p>\n<h2>24. Confidentiality<\/h2>\n<p>During your use of the Service, either party may receive non-public information from the other that should reasonably be understood to be confidential. Each party agrees to use reasonable care to protect confidential information and to use it only for purposes of the relationship unless disclosure is required by law, authorized by the owner, or the information becomes public through no fault of the receiving party.<\/p>\n<h2>25. Copyright and Intellectual Property Complaints<\/h2>\n<p>If you believe content in LevelUp Stats infringes your copyright or intellectual property rights, contact us at <a href=\"mailto:support@levelupstats.com\">support@levelupstats.com<\/a> with enough detail for us to investigate. We may remove or disable access to allegedly infringing content where appropriate.<\/p>\n<h2>26. Suspension and Termination<\/h2>\n<p>We may suspend, limit, or terminate your access to LevelUp Stats if you violate these Terms, fail to pay fees when due, create legal or security risk, use a fraudulent or compromised account, or if required by law, court order, government request, third-party platform requirement, or service discontinuation.<\/p>\n<p>You may stop using LevelUp Stats at any time and may cancel your subscription or request deletion according to available settings and our Privacy Policy.<\/p>\n<p>Termination does not relieve you of payment obligations incurred before termination and does not limit rights or obligations that by their nature should survive, including payment, ownership, confidentiality, disclaimers, limitation of liability, indemnification, and dispute terms.<\/p>\n<h2>27. Data Export and Deletion<\/h2>\n<p>Data export and deletion options may be available in account settings or by contacting support. Deletion is governed by our Privacy Policy and may be subject to legal, billing, tax, security, fraud-prevention, dispute-resolution, and backup retention requirements.<\/p>\n<p>Deleting your LevelUp Stats account does not automatically delete records held by third parties such as Stripe, Google, your hosting provider, WordPress, your own website, your own backups, or other services you control.<\/p>\n<h2>28. Disclaimers<\/h2>\n<p>To the maximum extent permitted by law, LevelUp Stats is provided \u201cas is\u201d and \u201cas available.\u201d We disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, security, and uninterrupted operation.<\/p>\n<p>We do not warrant that the Service will meet your requirements, recommendations will be accurate or effective, the Service will be uninterrupted or secure, third-party data will be available, plugin actions will work on every WordPress site, AI outputs will be correct, or SEO, rankings, visibility, traffic, leads, sales, revenue, or business results will improve.<\/p>\n<p>Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.<\/p>\n<h2>29. Limitation of Liability<\/h2>\n<p>To the maximum extent permitted by law, LevelUp Stats, 314media, and their owners, officers, employees, contractors, vendors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost traffic, lost rankings, lost data, lost goodwill, business interruption, website downtime, security incidents, plugin conflicts, search engine changes, AI output errors, third-party service failures, or costs of substitute services.<\/p>\n<p>To the maximum extent permitted by law, our total liability for all claims related to the Service will not exceed the greater of: (a) the amount you paid to LevelUp Stats for the Service in the three months before the event giving rise to the claim; or (b) one hundred U.S. dollars ($100).<\/p>\n<p>Some jurisdictions do not allow certain liability limitations, so some limitations may not apply to you.<\/p>\n<h2>30. Indemnification<\/h2>\n<p>You agree to defend, indemnify, and hold harmless LevelUp Stats, 314media, and their owners, officers, employees, contractors, vendors, and affiliates from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys\u2019 fees, arising from or related to your use of the Service, Customer Data, connected websites or accounts, approved actions, violation of these Terms, violation of law or third-party rights, lack of authority, or misuse of recommendations, AI outputs, reports, exports, or plugin actions.<\/p>\n<h2>31. Governing Law<\/h2>\n<p>These Terms are governed by the laws of the State of Missouri and applicable federal law, without regard to conflict-of-law principles.<\/p>\n<h2>32. Dispute Resolution and Venue<\/h2>\n<p>Before filing a claim, you agree to contact us at <a href=\"mailto:support@levelupstats.com\">support@levelupstats.com<\/a> and attempt to resolve the dispute informally. Include your name, account email, a description of the dispute, and the relief requested.<\/p>\n<p>Unless a different written agreement applies or applicable law requires otherwise, any legal action relating to these Terms or the Service will be brought in the state or federal courts located in Missouri, and you consent to personal jurisdiction and venue in those courts.<\/p>\n<h2>33. Force Majeure<\/h2>\n<p>We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, internet or hosting failures, power outages, cyberattacks, government actions, third-party platform outages, API restrictions, payment processor issues, search engine changes, or other events outside our control.<\/p>\n<h2>34. Assignment<\/h2>\n<p>You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, financing, corporate transaction, or transfer of the Service.<\/p>\n<h2>35. Changes to These Terms<\/h2>\n<p>We may update these Terms from time to time.
